New Jersey will start with brick-and-mortar ticket-taking. But as more investments come into the industry and sports betting becomes more prominent, it's not difficult to imagine a future where placing bets is as easy as opening an app on your phone. Dallas Mavericks owner Mark Cuban emphasized the role technology would play in the advent of legalized sports betting in America, saying "With technology, apps, and always-on access, it's something that will be a new form of entertainment that effects us all.
It could finally become fun to go to a baseball game again! They seem split. NBA commissioner Adam Silver made headlines in when he came out in favor of legalized sports gambling, while other leagues have been slower to embrace the idea. Now that the matter has been settled in court, chances are the leagues are most concerned with ensuring they'll get a piece of the gambling revenue pie. Still, there are plenty of ways for the leagues to generate revenue from this new development, from rights to set up gambling outlets in stadiums to partnering with sportsbooks for sponsorship deals.

In sum, regardless of the language sometimes used by Congress and this Court, every form of preemption is based on a federal law that regulates the conduct of private actors, not the States. Once this is understood, it is clear that the PASPA provision prohibiting state authorization of sports gambling is not a preemption provision because there is no way in which this provision can be understood as a regulation of private actors.
It certainly does not confer any federal rights on private actors interested in conducting sports gambling operations. It does not give them a federal right to engage in sports gambling. Nor does it impose any federal restrictions on private actors. Thus, there is simply no way to understand the provision prohibiting state authorization as anything other than a direct command to the States.
And that is exactly what the anticommandeering rule does not allow. A question posed by the majority opinion was over the current severability doctrine employed by the Supreme Court at the time of this decision. Under this doctrine, if the Court finds a portion of the law passed by Congress is deemed unconstitutional, they must review all other aspects of that law based on the intent of Congress to determine if some or all of the law must be deemed unconstitutional.
In a concurrence, Justice Thomas affirmed that the use of the severability doctrine was the right course of action in this decision, but postulated that the Court should revisit this doctrine since it often requires hypothesizing the intent of Congress. Justice Ginsburg wrote that the decision to overturn all of PASPA was excessive, and based on the desire to legalize sports betting.
The oral arguments in the case were considered to have gone favorably towards New Jersey and against the leagues, and many commentators believed that the Court would find that PASPA was unconstitutional. By June 5, , Delaware became the first state outside of Nevada to legalize sports gambling in wake of the Supreme Court decision.
In some cases, the leagues have been involved in helping to establish the legislation to be favorable for them as well, should the Court find for New Jersey. Interstate sports gambling remains illegal under the Federal Wire Act. With the Court finding in favor of New Jersey, observers believe its ruling will impact other current federal laws in place that could be considered to have commandeered power from the states and other challenges related to the Tenth Amendment, such as gun ownership rights, immigration enforcement eg.

Since PASPA prevented the states from authorizing sports betting, it violated the anti-commandeering rule. As stated above, many states have already taken steps to legalize sports betting. Although some venues sought to begin taking bets on Memorial Day, the governor and the legislature warned that those who did so before the enactment of the bill would be barred from taking bets.
Despite that minor setback, however, the legislature sought to take action in the next month, with the goal of presenting Governor Murphy will a bill to sign into law in June. Delaware is even closer to implementing sports betting. The recent Supreme Court decision opens the door to legalized sports betting, and in the coming weeks and months, many significant events will occur as the states scramble to pass laws and regulations to accommodate the public demand for sports betting.
In the meantime, if you have any questions about how these recent developments may affect you or your business, we are here to help. Landmark U. Click here for printable PDF On May 14, , the United States Supreme Court issued a highly anticipated decision that struck down the federal ban on state authorization of sports betting. New Jersey Gov.
Phil Murphy celebrated the decision, which began with a lawsuit brought by former-Gov. Chris Christie. The controversy started in , when New Jersey voters approved a measure to legalize sports betting to help the casino industries in a faltering economy. But the state law was immediately challenged by professional sports leagues and the NCAA, which pointed to a federal law passed in that bans state sports betting with some exceptions.
NCAA's chief legal officer Donald Remy said in a statement that while the organization is still reviewing how court's decision affects college sports, it will "will adjust sports wagering and championship policies to align with the direction from the court. Major League Baseball released a statement saying the decision will have "profound effects" on the sport.
Major American sports leagues -- including the NFL, NBA and the MLB -- offered cautious reaction to the news, saying they would take steps to protect the integrity of the games and called for regulatory framework. Justice Ruth Bader Ginsburg dissented, and joined by Justice Sonia Sotomayor and Justice Stephen Breyer in part, criticized the majority for wielding an ax to "cut down" down the entire statute instead of "using a scalpel to trim the statute.
The Professional and Amateur Sports Protection Act made it unlawful for a state to "sponsor, operate, advertise, promote, license, or authorize by law" sports wagering. Nevada was exempted from the law, and three other states -- Montana, Delaware, and Oregon -- that had already enacted sports lotteries were allowed to continue to do so. The law was passed out of concern that sports gambling might change the nature of sporting events from wholesome entertainment to a device for gambling.
At the time, New Jersey could have allowed sports wagering if it had acted within a year of the law's effective date, but chose not to. However, the state later changed its mind and passed a law to allow sports betting. Sports leagues challenged the law citing the law, and they won in federal court. New Jersey then tried to pass a new law in that simply repealed key provisions of its prohibitions on sports wagering to the extent they applied at racetracks and casinos.
Again, the courts ruled against the state, prompting Christie to take the case to the Supreme Court. New Jersey saw the case as a states' right issue and argued that the law is unconstitutional because it violates the so called "anti commandeering" principle of the 10th Amendment that bars Congress from ordering states to participate in a federal regulatory scheme.
